Reasons
1. Stephanie Magee, a BACP individual member, agrees to the following outcome of the investigation into a complaint of a failure to meet Professional Standards under reference PCP[…].
Background
2. At the relevant time the Member was a Social, Emotional and Mental Health (SEMH) school counsellor […].
The Association is concerned that the Member did not notify the Association, either at the time or when she renewed her membership, that she had been subject to a disciplinary investigation and that she was subsequently dismissed by her employer.
Admissions
3. The Member makes the following admissions which BACP accepts:
Allegation and Breach of Professional Standards
1.1 The Member failed to notify BACP that she was subject to a disciplinary investigation by her employer.
1.2 The Member thereby failed to meet professional standards, including in particular by acting in a way which was inconsistent with the following paragraph of Good Practice in the Ethical Framework for the Counselling Professions 2018: 47 (We will promptly notify this Association about any criminal charges or disciplinary procedures brought against us. We will also notify this Association of civil claims arising from work in the counselling professions, or if we have been declared bankrupt).
1.3 Allegation 1.1 amounts to Professional Misconduct as defined in the Professional Conduct Procedure.
Mitigation
4. The Member puts forward the following in mitigation which has been taken into account by the IAC in deciding the appropriate outcome.
The Member set out her personal, family and professional circumstances after her dismissal, explaining that these do not excuse her failure to report the matter but provide context for the circumstances she had been navigating and that she has worked hard to rebuild her professional life.
Conclusion
6. One of the aims of the Professional Conduct Procedure is to protect members of the public. The IAC in considering the appropriate outcome, including any sanction, for the admitted breach in this case has taken into account the interests of public protection and determined that it is reasonable and proportionate to conclude it on the terms set out below.
7. In relation to the findings above the IAC considers this case to be exceptional and does not consider it appropriate to make the Member subject to a sanction. In reaching this decision the IAC has taken into account the Member’s Preliminary Response and her request for Consensual Disposal in which she:
• recognises her obligation pursuant to paragraph 47 of the Ethical Framework to notify BACP of the disciplinary proceedings brought against her by the Organisation, regardless of any action that may be taken by an employer;
• takes full accountability for not notifying BACP;
• accepts that her failure to notify BACP amounted to professional misconduct;
• has expressed remorse for failing to notify BACP;
• describes the meaningful steps she has taken to reflect on and improve her undertaking of her ethical responsibilities, including engaging in in-depth supervision sessions focusing on ethical accountability, professional standards and the importance of reporting and recording in the profession;
• informs that she has re-read and reflected on BACP’s Ethical Framework, paying particular attention to paragraph 47 and regulatory reporting duties;
• informs that she has researched CPD guidance focusing on regulatory compliance, professional integrity and safeguarding the reputation of the profession;
• informs that she has developed a personal checklist and professional protocol to ensure timely and appropriate reporting of any future issues.
In addition, the Member has expressed her commitment to ensuring that she does not repeat her error and that she will maintain full compliance with BACP’s expectations and requirements thereby ensuring public trust in the profession.
8. The Member agrees that this Agreement will be published by the BACP in line with the Publication Policy and that it will be disclosed to the Referrer.
9. The Member agrees that she will not act in any way inconsistent with this Agreement such as, for example, by denying the admissions in paragraph 3 above.
10. If the Member acts in a way which is inconsistent with this Agreement the matter will be referred to a sanction panel for consideration. Such a decision would be published.
